Photo: IDF<\/figcaption><\/figure>\n<p>Amid the growing international consensus that the atrocities Israel has been committing in Gaza amount to genocide, a UN panel ahead has also concluded that \u201cgenocide is already happening\u201d in Gaza.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>The UN-mandated Committee on the Exercise of the Inalienable Rights of the Palestinian People (CEIRPP) convened this panel at UN headquarters in New York City on December 12, ahead of the vote in the General Assembly on the resolution calling for an \u201cimmediate humanitarian ceasefire\u201d.<\/p>\n<p><a href=\"https:\/\/twitter.com\/UNISPAL\/status\/1732770686190358985\">Tasked<\/a>\u00a0to \u201cexamine the legal implications of Israel\u2019s military offensive against Gaza since 7 October and shed light on the applicability of key legal frameworks including those defining Genocide\u201d, the panel was titled \u201c2023 War on Gaza: The Responsibility to Prevent Genocide\u201d.<\/p>\n<p>\u201cBut sadly it is clear that genocide is already happening, so our question now is the responsibility to stop the ongoing genocide,\u201d Hari Prabowo, Indonesia\u2019s Deputy Permanent Representative to the UN who chaired the panel discussion, said at its conclusion.<\/p>\n<p>On the same day, the International Federation for Human Rights (FIDH) also\u00a0<a href=\"https:\/\/www.fidh.org\/en\/region\/north-africa-middle-east\/israel-palestine\/the-unfolding-genocide-against-the-palestinians-must-stop-immediately\">adopted<\/a>\u00a0a resolution recognizing that \u201cIsrael\u2019s actions against the Palestinian people constitute an unfolding genocide.\u201d<\/p>\n<p>From November onwards UN experts, including several Special Rapporteurs and members of Working Groups on various issues, have been warning that there was\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2023\/11\/gaza-un-experts-call-international-community-prevent-genocide-against#:~:text=%E2%80%9CThe%20international%20community%2C%20including%20not,territory%2C%E2%80%9D%20the%20experts%20said\">\u201ca genocide in the making\u201d<\/a>\u00a0in Gaza.<\/p>\n<p>Consensus on the genocidal nature of Israel\u2019s war on Gaza has been consolidating since its early days. As early as October 15, just over a week after Israel started its bombardment, nearly 900 \u201cscholars and practitioners of international law, conflict studies and genocide studies\u201d from around the world had\u00a0<a href=\"https:\/\/twailr.com\/wp-content\/uploads\/2023\/10\/Gaza-public-statement-and-signatories.pdf\">warned<\/a>\u00a0of a \u201cpotential genocide in Gaza.\u201d<\/p>\n<p>In the two months since this warning, the death toll has increased by over seven-fold, with over\u00a0<a href=\"https:\/\/www.trtworld.com\/middle-east\/live-blog-about-8000-children-among-18800-killed-by-israel-in-gaza-16245560\">19,000 Palestinians<\/a>, mostly women and children, killed by the Israeli Occupation Forces (IOF) as of December 17. Thousands more remain buried under the rubble of the buildings Israel has bombed.<\/p>\n<p>But the number of the killed is not the factor determining whether or not the mass killing amounted to genocide, Katherine Gallagher, Senior Staff Attorney at the US-based Center for Constitutional Rights, explained in her presentation at the UN panel discussion.<\/p>\n<p>Pointing out that several Bosnian Serb political and military leaders were convicted of genocide for the \u201ckilling of over 7,000 Bosnian Muslim men and boys in Srebrenica\u201d in 1995, she added that it is the deliberate nature of the targeting of a group, \u201cthe intent, coupled with action\u201d, that determines that a mass killing amounts to genocide.<\/p>\n<p>By \u201ckilling\u201d and \u201ccausing serious bodily or mental harm\u201d, and \u201cdeliberately inflicting\u201d on Palestinians in Gaza \u201cconditions of life calculated to bring about its physical destruction in whole or in part\u201d, Israel has committed three of the five acts listed under the Genocide Convention.<\/p>\n<p>These acts, which constitute the \u201cphysical element\u201d of the genocide, have been documented thoroughly, shared widely on social media and broadcast on television daily \u2013 even hourly. However, these acts qualify as genocide only when the \u201cmental element\u201d is also demonstrated \u2013 namely that they were \u201ccommitted with intent to destroy, in whole or in part, a national, ethnical, racial or religious group\u201d.<\/p>\n<p>\u201cThe intent is the most difficult element to determine,\u201d\u00a0<a href=\"https:\/\/www.un.org\/en\/genocideprevention\/genocide.shtml\">explains<\/a>\u00a0the UN Office on Genocide Prevention and the Responsibility to Protect.<\/p>\n<p>\u201cBut in this case, the intent\u201d has been made \u201cexplicit\u201d in the statements \u201cby the Prime Minister, the President, by senior cabinet members and by the military leaders. These statements clearly constitute the mental element of the crime of genocide,\u201d Hannah Bruinsma, a legal advisor at Law for Palestine, said at the panel discussion.<\/p>\n<p>\u201cWe have collected so far 500 statements that demonstrate\u201d the genocidal intent, \u201coften of those in the chain of command,\u201d she added. Such statements of genocidal intent have been made since the early days of the war on Gaza and systematically repeated time and again.<\/p>\n<p><strong>\u201cNot mere rhetoric, but an admission of criminal intent\u201d<\/strong><\/p>\n<p>Army\u2019s spokesperson Daniel Hagari, who bragged of dropping \u201cthousands of tons of munitions\u201d on Gaza within the first couple of days of Israel\u2019s campaign, had no qualms\u00a0<a href=\"https:\/\/www.theguardian.com\/world\/2023\/oct\/10\/right-now-it-is-one-day-at-a-time-life-on-israels-frontline-with-gaza\">admitting<\/a>\u00a0that \u201cwe\u2019re focused on what causes maximum damage\u201d, rather than \u201caccuracy\u201d.<\/p>\n<p><a href=\"https:\/\/www.huffpost.com\/entry\/israel-defense-minister-human-animals-gaza-palestine_n_6524220ae4b09f4b8d412e0a\">Referring<\/a>\u00a0to Palestinians as \u201chuman animals\u201d, Defense Minister Yoav Gallant, who\u00a0<a href=\"https:\/\/www.timesofisrael.com\/gallant-israel-moving-to-full-offense-gaza-will-never-go-back-to-what-it-once-was\/\">prided<\/a>\u00a0in having \u201creleased all the restraints\u201d on the military, had\u00a0<a href=\"https:\/\/twitter.com\/AlArabiya_Eng\/status\/1712081490106876123\">said in the early days of the war<\/a>\u00a0that \u201cwe will eliminate everything\u201d in Gaza.<\/p>\n<p>Israeli tank in Gaza.<\/p>\n<p>Doubling down that \u201chuman animals must be treated as such\u201d, the army\u2019s Coordinator of Government Activities in the Territories, Maj. Gen. Ghassan Alian\u00a0<a href=\"https:\/\/www.timesofisrael.com\/liveblog_entry\/cogat-chief-addresses-gazans-you-wanted-hell-you-will-get-hell\/\">told<\/a>\u00a0Palestinians in Gaza that, \u201cthere will be no electricity and no water, there will only be destruction.\u201d<\/p>\n<p>Legitimizing the mass killing of civilians in Gaza, Israeli President Isaac Herzog had declared that \u201can entire nation out there is responsible\u201d for the October 7 attack on Israel by Hamas,\u00a0<a href=\"https:\/\/www.nbcnews.com\/news\/world\/everybody-scared-gaza-faces-threat-ground-invasion-tensions-run-high-i-rcna120346\">arguing<\/a>\u00a0that the \u201crhetoric\u201d about innocent civilians is \u201cabsolutely not true.\u201d<\/p>\n<p>\u201cThis practice of casting an entire population as enemies, as legitimate military targets, is a common genocidal mechanism,\u201d Raz Segal, a prominent Jewish Israeli scholar of Holocaust and Genocide Studies, said in his remarks at the panel discussion.<\/p>\n<p>Late in October, Prime Minister Benjamin Netanyahu went on to compare Palestinians with the biblical enemy of the Jews. \u201cYou must remember what Amalek has done to you,\u201d he\u00a0<a href=\"https:\/\/www.gov.il\/en\/departments\/news\/statement-by-pm-netanyahu-28-oct-2023\">quoted<\/a>\u00a0from the Old Testament which prescribes, \u201cNow go and smite Amalek, and utterly destroy all that they have, and spare them not; but slay both man and woman, infant and suckling, ox and sheep, camel and ass.\u201d<\/p>\n<p>These statements, which \u201chave been given effect\u201d must be understood to be \u201cnot mere rhetoric, but an admission of criminal intent\u201d, Gallagher argued. \u201cIsraeli officials have done what they said they would do.\u201d<\/p>\n<p><strong>Journalists guilty of inciting genocide<\/strong><\/p>\n<p>\u201cThese expressions of intent need to be understood also in relation to the widespread incitement to genocide in Israeli media since 7 October,\u201d said a\u00a0<a href=\"https:\/\/contendingmodernities.nd.edu\/global-currents\/statement-of-scholars-7-october\/\">statement<\/a>\u00a0on December 9 by over 55 scholars in Holocaust and Genocide Studies.<\/p>\n<p>From the calls to turn Gaza \u201cinto a slaughterhouse\u201d and \u201cviolate all norms on the way to victory\u201d to saying \u201clet there be a million bodies\u201d of dead Palestinians, there are \u201cdozens and dozens of examples of incitement in Israeli media\u201d, said Segal, one of the signatories of the statement.<\/p>\n<p>\u201cIt is worth reminding\u201d that in the aftermath of the Rwandan genocide, journalists who had been encouraging the crime when it was unfolding were \u201cput on trial and convicted.. of incitement to genocide, which is a separate crime under Article 3 of the UN Genocide Convention,\u201d he added.<\/p>\n<p><strong>\u201cUS is complicit in Genocide\u201d<\/strong><\/p>\n<p>Also listed as a separate crime in the same article is \u201ccomplicity in genocide\u201d, of which the US is guilty, argued Gallagher. The Center for Constitutional Rights, which she represented in the panel discussion, has filed a\u00a0<a href=\"https:\/\/ccrjustice.org\/sites\/default\/files\/attach\/2023\/11\/Complaint_DCI-Pal-v-Biden_w.pdf\">legal complaint<\/a>\u00a0in a California District Court against US President Joe Biden, Secretary of State Antony Blinken and Secretary of Defense Lloyd Austin, for their complicity in Israel\u2019s genocide.<\/p>\n<p>\u201cThis unfolding genocide of the Palestinian people in Gaza has so far been made possible because of the unconditional support given\u201d to Israel by the US in breach of its \u201cresponsibilities under customary international law\u2026to prevent, and not further, genocide,\u201d states the\u00a0<a href=\"https:\/\/ccrjustice.org\/sites\/default\/files\/attach\/2023\/11\/Complaint_DCI-Pal-v-Biden_w.pdf\">complaint<\/a>.<\/p>\n<p>The US, which is Israel\u2019s \u201clargest provider of military, economic and political assistance, and I would argue, political cover.. has the ability to use its considerable influence and unique position to take all measures to stop Israel\u2019s unfolding genocide,\u201d Gallagher argued.<\/p>\n<p>\u201cInstead\u201d, she said, it \u201chas done the opposite.\u201d Biden, Blinken and Austin have \u201cpledged and continue to pledge all support to Israel. They have rushed military support, ammunition, precision-guided munitions, 2,000-pound bunker bombs, and they\u2019ve been flying drones overhead. The US military advisers have been in (Israel\u2019s) war cabinet sessions.\u201d<\/p>\n<p>US is Israel\u2019s biggest financial and military backer. Photo: IDF<\/p>\n<p>In addition to the annual 3.8 billion dollars it hands out to Israel every year, it is now coughing up \u201can additional 14.5 billion dollars, without conditions.\u201d US officials have reiterated in multiple press conferences that \u201cthere are no red lines or conditions for these weapons\u201d, she said.<\/p>\n<p>The\u00a0<em>Washington Post<\/em>\u00a0<a href=\"https:\/\/www.washingtonpost.com\/national-security\/2023\/12\/09\/us-weapons-israel-gaza\/\">reported<\/a>\u00a0earlier this month that Israel has dropped more than 22,000\u00a0 US-supplied bombs on Gaza within the first month and a half of the war. This amounts to almost one US bomb per every 100 of the 2.3 million Palestinians who are practically imprisoned in the 365 sq. km strip of land that Israel has held under siege for 17 years, which itself has been described by Jewish Israeli historian Ilan Pappe as an\u00a0<a href=\"https:\/\/www.palestinechronicle.com\/using-the-right-language-the-incremental-genocide-of-the-palestinians-continues\/\">\u201cIncremental Genocide\u201d<\/a>.<\/p>\n<p><strong>\u201cForced displacement\u2026has figured in genocidal processes\u201d<\/strong><\/p>\n<p>Situating \u201cthe ongoing genocide in Gaza\u201d in the \u201cbroader context of Israel\u2019s violent settler colonialism and occupation of Palestinian land,\u201d Jehad Abusalim, Executive Director of The Jerusalem Fund, said \u201cthis process began in 1948\u201d with the establishment of Israel.<\/p>\n<p>The\u00a0<em>Nakba<\/em>, the Arabic word meaning catastrophe, refers to the expulsion of 750,000 Palestinians from their land within a year of the establishment of this settler colonial state on 78% of Palestine. The process of the Nakba, he said at the panel discussion, never stopped.<\/p>\n<p>\u201cThe\u00a0<em>Nakba<\/em>\u00a0was not just an event in the distant past\u201d, but \u201ccontinues to unfold in Gaza today. It is a process of continuous displacement and ethnic cleansing.\u201d<\/p>\n<p>\u201cForced displacement, what is commonly called ethnic cleansing, is not in itself an act of genocide, but we know that historically it has figured in genocidal processes,\u201d added Segal, who\u00a0<a href=\"https:\/\/jewishcurrents.org\/a-textbook-case-of-genocide'\">describes<\/a>\u00a0Israel\u2019s actions in Gaza as \u201ca textbook case of genocide\u201d.<\/p>\n<p>\u201cIt took the Nazis two and a half years\u2026 of experimenting with various schemes of forced displacement of Jews\u201d before
